What is Consumer Dispute ?

PF and ESIC return filing is the mandatory monthly process where an employer submits a detailed report of the contributions made by both the company and its employees toward social security and health insurance. Unlike the registration (which is a one-time event), Return Filing is an ongoing monthly commitment that informs the government exactly how much was deducted from each employee’s salary and ensures those funds are credited to the correct individual accounts.


Key Components of the Filing Process

  • ECR (Electronic Challan-cum-Return): This is the heart of the filing process. It is a digital file containing the UAN (Universal Account Number) of each employee, their monthly wages, and the specific contribution amounts.

  • Validation: Before submission, the portal validates the data to ensure that the contribution percentages (e.g., 12% for PF) match the reported wages.

  • Challan Generation: Once the return is uploaded and verified, a temporary TRRN (Temporary Return Reference Number) is generated, which leads to the creation of the electronic challan used for payment.

The Consumer Protection Act, 2019, is a milestone legislation in India designed to empower consumers and simplify the grievance redressal process. Replacing the outdated 1986 Act, this law introduces the Central Consumer Protection Authority (CCPA) to regulate matters relating to the violation of consumer rights. It focuses on modern marketplace challenges, such as e-commerce and misleading advertisements, ensuring that the consumer is protected whether they shop online or offline. The primary objective is to maintain a fair balance between buyers and sellers, providing a speedy and effective mechanism for resolving disputes.

Compensation & Penalties As Per Bill, 2019

To deter unfair trade practices, the 2019 Act introduces stringent penalties and comprehensive compensation rights. A major highlight is the introduction of Product Liability, which makes manufacturers and service providers legally accountable for any harm caused by defective products or deficient services. Consumers no longer need to prove negligence; the mere existence of a defect is sufficient to seek compensation.

Additionally, the Act takes a hard stand against misleading advertisements. The CCPA has the power to impose fines of up to ₹10 Lakh and imprisonment of up to 2 years on manufacturers or endorsers for false claims. For subsequent offenses, the fine can escalate to ₹50 Lakh with imprisonment extending to 5 years. Furthermore, the Act provides the “Right to file a complaint from anywhere,” allowing consumers to seek justice from their home or office regardless of where the purchase was made.
